Please read these Terms of Service carefully before using our services.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you and Sustainable TDP ("we," "us," or "our") governing your access to and use of our website, products, and services.
By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access our services.
2. Services Description
Sustainable TDP provides enterprise container solutions and sustainability consulting services, with expertise in Red Hat OpenShift and Kubernetes.
We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our services.
3. User Accounts
Some features of our services may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lowercase letters, numbers, and symbols) with your account.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Intellectual Property
Our website, products, and services, including without limitation all text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are the property of Sustainable TDP or our suppliers and protected by United States and international copyright, trademark, and other intellectual property laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
5. User Content
You may have the opportunity to post content on our services, including but not limited to reviews, comments, and submissions ("User Content"). You retain all ownership rights in your User Content, but you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with our services.
You represent and warrant that:
- You own the User Content or have the right to use it and grant us the rights and license as provided in these Terms.
- Your User Content does not violate the privacy rights, publicity rights, copyrights, contractual rights, intellectual property rights, or any other rights of any person.
- Your User Content does not contain any material that solicits personal information from anyone under the age of 18 or exploit people under the age of 18 in a sexual or violent manner.
- Your User Content does not violate any applicable law, regulation, or rule.
- Your User Content is not threatening, harassing, defamatory, libelous, hateful, racist, or otherwise offensive or inappropriate.
We reserve the right to remove any User Content from our services at our discretion, without prior notice, for any reason or no reason, including User Content that we believe violates these Terms or our policies.
6. Prohibited Uses
You agree not to use our services for any of the following prohibited activities:
- Violating any applicable laws, regulations, or rules.
- Infringing upon the intellectual property rights of others.
- Transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Interfering with or disrupting our services or servers or networks connected to our services.
- Impersonating or attempting to impersonate Sustainable TDP, a Sustainable TDP employee, another user, or any other person or entity.
- Collecting or tracking the personal information of others.
- Engaging in any conduct that restricts or inhibits anyone's use or enjoyment of our services.
- Using our services in a manner inconsistent with any applicable laws or regulations.
7. Disclaimer of Warranties
Our services are provided on an "AS IS" and "AS AVAILABLE" basis. Sustainable TDP expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Sustainable TDP does not warrant that our services will meet your requirements, be available on an uninterrupted, timely, secure, or error-free basis, or be accurate, reliable, free of viruses or other harmful code, complete, legal, or safe.
8. Limitation of Liability
In no event shall Sustainable TDP, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use our services.
- Any conduct or content of any third party on our services.
- Any content obtained from our services.
- Unauthorized access, use, or alteration of your transmissions or content.
The limitations of liability set forth above shall apply to the fullest extent permitted by law in the applicable jurisdiction.
9. Indemnification
You agree to defend, indemnify, and hold harmless Sustainable TDP, its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of our services.
10. Termination
We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use our services will immediately cease. If you wish to terminate your account, you may simply discontinue using our services.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Sustainable TDP is incorporated, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our services.
